This Privacy Policy explains clearly and comprehensively what personal data we collect, how we use it, the circumstances in which we share it, how we protect it, and the rights and choices available to you.

By using the Aiviue Platform, which includes our website, web and mobile applications, WhatsApp-based conversational experiences, QR-code job apply flows, AI assistant interactions, employer dashboards, and all related services, you acknowledge that you have read and understood this Privacy Policy and agree to the practices described herein.

Aiviue strives to maintain transparency, fairness, and accountability in all its data practices so that users can trust that their information is handled with the utmost care.

2. Legal Framework and Applicability

This Privacy Policy has been designed to comply with major global privacy frameworks, particularly:

  • The Digital Personal Data Protection Act, 2023 ("DPDP Act") of India
  • The Information Technology Act, 2000, and associated IT Rules concerning data security and reasonable practices
  • The General Data Protection Regulation (GDPR) of the European Union, where applicable

This Policy applies to job seekers, candidates, employers, recruiters, hiring managers, platform visitors, individuals interacting with our conversational assistant Aivi, and representatives of companies that use or integrate with the Aiviue Platform.

This Policy does not apply to data independently collected by employers for their internal processes. Employers remain responsible for their own privacy practices.

4. Eligibility to Use the Platform

The Aiviue Platform is intended for individuals who are at least 18 years of age, which is the minimum legal age to enter into employment in most jurisdictions. We do not knowingly collect or process personal data of minors or individuals who do not meet legal employment requirements. If we become aware that data belonging to a minor has been collected, we will delete such data promptly.

5. What Personal Data We Collect

The personal data we collect depends on the services you use, your interactions with Aivi or the Platform, and your role as a job seeker or employer. We aim to collect only the information that is reasonably necessary for delivering our services effectively.

5.1 Personal Data You Provide Directly

For Job Seekers

Information provided during sign-up, profile creation, or while applying for jobs, including:

  • Name, phone number, email address, city
  • Job preferences, expected salary, preferred location
  • Resume/CV, education, certifications, skills, and work experience
  • Video resumes or video introductions
  • Responses to screening questions
  • Documents for onboarding (if hired), such as ID proofs or certificates
  • Messages sent through WhatsApp or other communication channels associated with our Platform

For Employers and Recruiters

  • Name, email, phone number, designation
  • Company information and address
  • Job descriptions, preferences, hiring criteria, and other job-posting details
  • Feedback on candidates and interview schedules

For All Users

  • Support queries, complaints, surveys, feedback, and any other voluntary interactions with us

5.2 Data Collected Through Aivi (AI Assistant)

Aivi collects conversational data and related information to improve interaction quality and hiring workflow efficiency. This includes:

  • Chat transcripts
  • Responses to structured and follow-up questions
  • Summaries generated from your resume or input
  • Behavioural signals such as speed of response or completion patterns
  • Optional audio or video messages if shared during the conversation

This data enables Aivi to assist with profile building, job recommendations, screening, and employer insights.

5.3 Automatically Collected Data

Aiviue may automatically collect technical and usage-related data such as:

  • Device type, browser type, operating system
  • IP address, time zone, language preferences
  • Session details, page visits, clicks, interaction patterns
  • Cookies and identifiers used for authentication and analytics
  • WhatsApp Business API metadata such as timestamps (but never private user chats outside our bot)

This helps us maintain performance, personalize experiences, and secure the Platform.

5.4 Data Received from Third Parties

We may receive information from:

  • Employers uploading candidate data
  • HR platforms, job boards, ATS integrations
  • Verification or assessment partners (initiated by employers)
  • Payment gateways (only transaction status)
  • Public sources such as LinkedIn

6. How We Use Your Personal Data

Your personal data is used to enable hiring workflows, support job applications, improve service quality, and ensure compliance with applicable laws.

6.1 To Deliver and Operate Our Platform

We use your data to create user accounts, match candidates with jobs, manage employer dashboards, send updates and notifications, schedule interviews, send reminders, and assist in job application flows.

6.2 To Enable Aivi's Functionality

Aivi may use your data to:

  • Ask relevant questions and complete your profile
  • Parse resumes and summarize key details
  • Generate fitment suggestions based on employer criteria
  • Recommend jobs and opportunities
  • Assist employers by summarizing information and helping them view profiles more efficiently

These outputs are guidance only and do not determine employment outcomes.

6.3 To Improve and Personalize the Platform

We analyze aggregated and anonymized data to:

  • Enhance app performance
  • Improve matching and recommendation systems
  • Optimize user journeys and reduce drop-offs
  • Enhance fairness and reduce bias across AI models

6.4 To Comply with Legal and Security Obligations

We may use your data to detect fraud, prevent misuse, ensure platform safety, respond to legal obligations, or fulfill regulatory requirements.

7. How Aivi (AI Assistant) Works and Its Limitations

Aivi is designed to assist and improve hiring efficiency for job seekers and employers by providing conversational guidance, structured questions, and informational summaries.

7.1 What Aivi Can Do

  • Generate suggestions for employers based on employer-defined criteria
  • Summarize candidate information from resumes and responses
  • Help candidates discover suitable jobs
  • Assist in scheduling interviews and sending reminders
  • Provide automated responses to frequently asked questions

7.2 What Aivi Cannot Do

  • Make hiring or rejection decisions
  • Decide whether a candidate should be selected or shortlisted
  • Rank candidates in a legally binding or deterministic manner
  • Override employer judgment or influence their hiring decisions

Employers make all hiring decisions independently and solely at their discretion.

8. Right to Human Review of AI Guidance

If you require clarification on how Aivi produced a particular suggestion or insight, you may request a human review by emailing privacy@aiviue.com. Aiviue can explain how its AI guidance was generated, based on inputs and employer criteria.

However, Aiviue cannot explain:

  • Why an employer selected a particular candidate
  • Why a candidate was not shortlisted
  • How employer-specific evaluations or decisions were made

Aiviue does not control employer hiring actions and therefore cannot review or override them.

9. Legal Basis for Processing Personal Data

Under the DPDP Act, Aiviue primarily processes data based on consent, purpose limitation, and data minimization.

Under the GDPR, our legal bases include:

  • Consent given voluntarily by the user
  • Processing necessary for providing the Platform and its services
  • Legitimate interests such as improving efficiency and security

10. Consent and Withdrawal of Consent

By creating an account or using the Platform, you consent to:

  • Processing of your personal data
  • Use of your profile for job matching and recruitment activities
  • Sharing your profile with employers as part of a job application
  • Communication through WhatsApp, email, SMS, or app notifications
  • Use of anonymized data for AI model improvement

You may withdraw consent by deleting your account or writing to privacy@aiviue.com. Withdrawal may impact your ability to use the Platform.

11. AI Training and Model Improvement

By signing up, you explicitly consent to Aiviue using anonymized, de-identified, or aggregated data to train and improve AI systems. This includes:

  • Improving the accuracy and quality of Aivi's responses
  • Enhancing fairness and reducing unintended bias
  • Improving job recommendations and hiring efficiency
  • Conducting performance analytics

Identifiable personal data is not used for training AI models.

12. Sharing Your Personal Data

Aiviue does not sell personal data. Data may be shared only when necessary to perform services or comply with law.

12.1 Sharing with Employers

Your data is shared with employers only when you apply to a job or express interest in opportunities.

12.2 Sharing with Service Providers and Partners

We may share limited data with:

  • Cloud hosting platforms
  • Communication service providers
  • HR technology partners
  • Assessment or verification partners
  • Payment processors
  • Analytics and security partners

All partners operate under confidentiality and data protection obligations.

12.3 Sharing Required by Law

We may share data if required by courts, regulatory bodies, or law enforcement.

13. Data Retention

Candidate profiles and video resumes: Retained for as long as your Aiviue account remains active, unless you delete them.

Chat transcripts: Retained for a maximum of 90 days, after which they are automatically deleted.

Employer and recruiter data: Retained for the duration of the business relationship and any legally required retention period.

Upon account deletion, all personal data is deleted except where the law requires retention.

14. Your Rights

Aiviue maintains a transparent system for users to manage their data directly through their profile pages.

14.1 Right to Access

You may view and access the personal information stored under your profile at any time.

14.2 Right to Correction

You may correct or update inaccurate or incomplete information directly by editing your profile.

14.3 Right to Deletion

You may delete your resume, video resume, documents, or your entire account at your convenience through the Platform.

14.4 Right to Withdraw Consent

You may withdraw your consent by deleting your account or contacting privacy@aiviue.com.

14.5 Rights Not Applicable

  • Right to restrict processing does not apply because processing relies on ongoing consent.
  • Right to explanations of employer decisions does not apply because Aiviue does not participate in hiring decisions.

15. Security of Personal Data

Aiviue implements strong technical and organizational measures to protect your personal data, including:

  • Encryption of personal data in transit and at rest
  • Strict access controls and user authentication
  • Monitoring and auditing of platform activity
  • Regular vulnerability assessments and security reviews
  • Secure integrations with external platforms

Users are responsible for maintaining the confidentiality of their credentials and securing their devices.

16. Cookies and Tracking Technologies

Aiviue uses cookies and similar technologies to facilitate authentication, improve user experience, and collect analytics. You may disable cookies in your browser settings, but some platform features may not function correctly.
